Does eBay specify that "speculating" is wrong ?  It's done every day, and a 
great way to do business, buying something only after you've sold it.

I think he's allowed to sell something he speculates that he reasonably will 
have (unless eBay has a policy against this ?), but the real problem could 
come from not actually being able to acquire the wheels, after selling them 
to a third party.  Paying for them would help to ensure that this happens, 
and that he can fulfill his promise.

This seller could have a problem if he doesn't pay the current owner for the 
wheels, and therefore never gets them to sell.

It all seems to hinge on whether he pays the first owner of the wheels for 
them.

This gets more legalistic than I can get, not being a lawyer, but it seems 
very interesting anyway.

Did the first owner get paid yet ?  Therein lies the rub, so to speak ...
